BASIC INFORMATION

1. What is this case about?

This case is known as Lim v. TradeZero America, Inc., Case No. 1:24-cv-01196- GBW (D. Del.), pending in the United States District Court for the District of Delaware. The person who sued is called the “Plaintiff,” and the company being sued, TradeZero America, Inc., is known as the “Defendant” in this case. Plaintiffs filed the Lawsuit against Defendant, on behalf of themself and anyone whose Personal Information was potentially impacted as a result of the Incident.

On or around September 19, 2024, TradeZero began notifying Settlement Class Members, including Plaintiff, of a cybersecurity incident that occurred on or around July 29, 2024. TradeZero advised that, during the Incident, an unauthorized actor may have accessed personal information contained in certain files associated with customer communications that were contained on the Tawk.To platform.

2. Who is a settlement class member in this settlement?

You are a Settlement Class Member if the Claims Administrator identified you as being among those individuals residing in the United States whose PII was or may have been affected by the Incident.

3. What does the Settlement provide?

The proposed Settlement will provide the following benefits to Settlement Class Members:

Cash Payment A – Documented Loss. Settlement Class Members may submit a Claim for Cash Payment A for up to $10,000.00 each upon presentment of Documented Losses related to the Incident. Settlement Class Members electing Cash Payment A shall not be reimbursed for expenses if they have been reimbursed for the same expenses by another source, including compensation provided in connection with the credit monitoring and identity theft protection product offered as part of the notification letter provided by Defendant or otherwise.

Cash Payment B – Time Compensation. Settlement Class Members may submit a claim for Cash Payment B for up to five (5) hours of time compensation spent dealing with the incident, calculated at $30 per hour.

Cash Payment C – Credit Monitoring Equivalent.  Whether a Settlement Class Member submits a claim for Cash Payment A and/or B, they may also elect, and be entitled, to receive Cash Payment C, which is the Credit Monitoring Equivalent. The amount a Settlement Class Member can receive from Cash Payment C is capped at $300.00.

Credit Monitoring. All Claimants will receive three years of Credit Monitoring Services unless they elect to receive Cash Payment C.

Claims will be subject to review for completeness and plausibility by the Settlement Administrator.

4. How do I get benefits?

By submitting a valid Claim Form by June 15, 2026.

All Claim Forms will be reviewed by the Settlement Administrator for completeness and plausibility. Additional information may be requested from any claimant.  If the required information is not provided in the time required, the claim will be considered invalid and will not be paid.

5. What happens if I do nothing?

If you do nothing, you will be bound by the Settlement if the Court approves it, you will not get any monetary relief or credit monitoring services from the Settlement, you will not be able to start or proceed with a lawsuit, or be part of any other lawsuit against the Released Parties about the settled claims in this case at any time.

6. How can I update my address?

You can update your address when you submit a claim form.  If your address changes after you submit your claim form, you can email the Settlement Administrator at TradeZerodatasettlement@noticeadministrator.com to update your address providing your name, claim number, old address, and new address.
